The ART Act is the smallest of them. The bigger constraints are an older Indian statute, an advertising code, and the policies of the two platforms you were planning to spend the money on. ## What growth and acquisition covers in a fertility clinic Lead capture, follow-up and attribution. An enquiry arrives from a form, a call, a walk-in or a message, it goes to someone, that person works it, and eventually the clinic wants to know which source produced the patients who actually booked. The mechanics are not unusual. What is unusual is the compliance layer sitting on top of every message you send and every ad you run. ## The ART Act advertising ban is narrower than people assume Read carefully and the advertising prohibition in the ART Act is specific. It targets sex selection. It is not a general ban on advertising fertility services. Clinics routinely over-apply this and under-apply everything else, which is exactly backwards. The Act's marketing exposure is narrow. Its penalty exposure is not. Offences carry criminal penalties and the drafting reaches an agent thereof, language broad enough to pull in people acting on the clinic's behalf. If you use an outside agency, that phrasing is worth showing them. ## The statute that actually catches fertility copy The Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954 is the one that bites, and almost nobody in fertility marketing has read it. It restricts advertising that claims to improve or restore fertility, and it reaches guarantee-style claims generally. That covers a large share of the copy a clinic would naturally want to write. Phrasing like improve your chances, or anything implying a promised result, sits inside its scope. This is a 1954 statute governing 2026 landing pages, and it does not care that the format changed. There is a second one worth knowing if your group also does prenatal imaging. Under the PC-PNDT Act, section 22 names website hosts and developers among those who can be held liable. Not just the clinic. The people who built and host the site. If you run a chain that touches diagnostics, your web vendor has statutory exposure they may not know about. ## The advertising code adds a standard, not just a rule The Advertising Standards Council of India requires that claims be substantiable and directs special care when advertising to audiences dealing with infertility, on the grounds that they are more susceptible to persuasion. Substantiable is the operative word. It means holding evidence for what you claim before you publish, not after someone complains. And the special care provision reframes tone as a compliance matter rather than a taste one. Urgency copy, countdown pressure and emotive appeals aimed at people trying to conceive are precisely what that provision exists to restrain. ## The platforms restrict you before the law does This is where most clinic campaigns die, and it has nothing to do with Indian law. Google restricts fertility advertising in more than twenty countries and treats it as a sensitive category. Meta prohibits ad copy that implies a personal health attribute about the person seeing it, which means the most natural sentence a fertility clinic would write, something addressing the reader directly about struggling to conceive, is disallowed on its face. The workable approach is to write about the service rather than about the reader's condition. Describe what the clinic does. Do not tell the reader what you have inferred about them. That single discipline resolves most rejections, and it also happens to align with the ASCI position on how these audiences should be addressed. ## Attribution breaks over a long decision window There is a structural mismatch in fertility that most attribution setups never account for. Google's click identifier has a limited lifetime for offline conversion import, in the region of ninety days. Fertility decision windows routinely run longer than that. A patient who clicks an ad in March, thinks about it for five months and books in August is a conversion the platform will not accept back, so the channel that produced them looks worse than it was, and budget moves away from it. The counter is to store the click identifier on the lead record at capture and keep it, so that even when the platform will no longer ingest the conversion you can still answer the question internally. That is a CRM requirement rather than an advertising one, and it is worth checking before you buy: does the system store the inbound click identifier, and can you report on it months later. Follow-up cadence carries the same shape of problem. Most sales cadences are designed for decisions made in days. Fertility decisions are made over months, often around a treatment cycle the clinic cannot see. A cadence that exhausts itself in two weeks will mark as lost a patient who was always going to come back in June. This is a pattern reported by practitioners rather than a documented finding, so treat it as a question to examine in your own data rather than a rule. ## What to check when you evaluate Ask whether the system stores the inbound click identifier on the lead record and for how long. Ask whether marketing consent is recorded separately from treatment consent, with a date and a withdrawal trail, since that is a legal requirement rather than a preference. Ask whether follow-up sequences can run over months rather than days without a lead being auto-closed. Ask who owns an unworked lead and what happens when nobody touches it. And before any campaign goes live, ask two questions of every line of copy: can we substantiate this claim, and does it tell the reader something about their own body.
